New Zealand was placed under the Dependency of New South Wales by Royal Charter/Law of Nations on 30 July 1839 with the Proclamation being read by Lt. Governor Hobson at Waitangi on the 30 January 1840, a week before the Treaty was signed. The Treaty gave the tangata Maori, “The same rights as the people of England”, no more, no less.
Once the Treaty of Waitangi was signed, New Zealand could no longer remain under the dependency of New South Wales as the natives of Australia did not have the same rights as the natives of New Zealand, therefore, Britain had to separate New Zealand from New South Wales dependency. This was achieved by another Royal Charter/Letters Patent dated 16 November 1840 that made New Zealand into a separate British Colony with its own Governor and Constitution to set up its own political, legal and justice systems under one flag and one law, irrespective of race colour or creed. It would have been far easier and cheaper for New Zealand to remain under the dependency of New South Wales, but the Treaty of Waitangi “stuffed this up” as New South Wales had no legislation that gave the natives of Australia the same right as the people of England.
